Trade Secret Protections Lacking, Chemical Companies Tell EPA

Companies’ confidential information wouldn’t get the protection it needs under a proposed EPA chemical rule, according to industry associations. The EPA’s proposed rule (RIN: 2070-AK21) describes the process the agency would use to decide whether specific identities of certain chemicals would continue to be kept confidential—the agency would know the identities but not the public.
The 2016 Toxic Substances Control Act amendments required companies to justify their need for this confidentiality and required the EPA to review the claims to decide whether they’re reasonable.
