Chemicals Coalition Wants UK To Use European Legislation After Brexit

When Britain leaves the European Union (EU), it will affect a huge number of industries, including chemical manufacturing and its toll processing services. That is why a coalition of British and European chemical NGOs wants the UK to still abide by legislation after Brexit. They wrote an open letter – which was published in the Financial Times – to European leaders asking for Britain to be bound by the EU’s Registration, Evaluation, Authorisation and Restriction of Chemicals legislation (REACH). If they are not, this could result in a less-competitive market for the chemicals industry and it could also have an environmental impact if EU laws are not adhered to.

The Australian Government announced its intention to implement reforms to the way in which industrial chemicals are regulated. The reforms are intended to streamline the process of assessing industrial chemicals to reduce the regulatory burden and to make regulatory effort more proportionate to risk. The Industrial Chemicals Act, which was passed by Parliament in February of 2019 and received Royal Assent in March of 2019, creates a new framework for the regulation of imported or manufactured industrial chemicals. The new scheme, referred to as the Australian Industrial Chemicals Introduction Scheme, or AICIS, will replace the current National Industrial Chemicals Notification and Assessment Scheme, referred to as NICNAS.

A Coordinated Approach to Chemical Reactivity

Atoms are gregarious by nature, escaping a solitary existence by forming chemical bonds with their neighbors. Chemical reactivity, in turn, depends on the degree of atomic “isolation”; a lonely atom will more readily interact and form bonds with others, as compared to its more “coordinated” counterparts that are chemically engaged with other atoms. This coordination concept plays a central role in our understanding of chemical and catalytic activity. What has been lacking to date, however, is a direct and quantitative measurement of the variation in chemical reactivity of atoms having different degrees of coordination.

The Trump EPA’s “Working Approach” to new chemical reviews is only working for the chemical industry

The Trump EPA has worked very hard to render this long-awaited update of its approach to reviewing new chemicals under TSCA an empty exercise. Despite Administrator Wheeler’s promises in January 2019 to the contrary: EPA has still failed to provide any legal or scientific justification for its Working Approach. EPA provided no actual response to the many detailed comments it received on its 2017 framework, instead issuing a 1.5-page document that dismisses many of the comments merely as having “stemmed from a misunderstanding of the Agency’s intent.”
